Court Halts Transfer of Labor Jurisdiction to Buenos Aires

Recently, the National Court of First Instance No. 30 granted the request of the National Union of Judicial Employees (UEJN). The union challenged the constitutional invalidity of the articles of the so-called 'Labor Modernization Law', which established the transfer of powers from the National Labor Court to the jurisdiction of Buenos Aires. Last week, Judge Enrique LaviƩ Pico had rejected a similar request from the General Confederation of Labor (CGT). National Judge Herman Mendel granted the union's request, which also demanded 'the abstention regarding the issuance and/or implementation of any act that implies the transfer of judicial functions from the National Labor Court to the Autonomous City of Buenos Aires'. Thus, the judge suspended 'the entire effects of the Agreement on the Transfer of the Judicial Function in Labor Matters from the National Scope to the Labor Court of the Autonomous City of Buenos Aires'. The ruling was announced as judicial workers from the labor jurisdiction were protesting at the Palace of Justice, the seat of the Supreme Court of Justice of the Nation, who celebrated the news. This morning, judicial workers from the labor jurisdiction protested at the Palace of Justice. The decision was made by National Judge Herman Mendel.
